Europeana pre-conference on the Public Domain Charter
 
Should work that is in the public domain remain there after a format change? Or can new rights be claimed when an out-of-copyright item is digitised?
 
This is the fundamental issue in the discussion of IPR, digitisation and public access. There is no easy answer and Europeana’s content providers, partners and stakeholders represent several shades of opinion.
 
The Charter is a statement of purpose, not a contract, and it doesn’t bind Europeana’s content providers to any position. It is intended to influence the debate about ways in which digital content from the cultural and scientific heritage could be used – and re-used – to stimulate creative enterprise and innovation in Europe.
 
The first draft of the Charter stimulated a robust debate at Europeana’s September Conference, Creation, Collaboration and Copyright. Continuing the consultation process, this next draft resolves a number of key concerns, while retaining its clarity of vision.
 
To focus the discussion, the Europeana team is joined by Paul Keller, from Kennisland, and Lucie Guibault, from the Institute for Information Law at the University of Amsterdam.
